Article 8 – Satisfaction Guaranteed or Money Back within 14 Days – Right of Withdrawal

8.1 – General provisions
In accordance with applicable statutory provisions, you shall have a period of fourteen (14) calendar days from receipt of the Products to exercise your right of withdrawal from Librairie Maritime Nautic Way, without providing any reason and without incurring any penalty.

Where the right of withdrawal is duly exercised within the aforementioned period, only the price of the Product(s) purchased together with the initial delivery costs shall be reimbursed; return shipping costs shall remain at your sole expense.

Returned Products must be sent back in their original and complete condition (including packaging, accessories, instructions, etc.), suitable for resale in new condition, and must be accompanied by a copy of the purchase invoice in order to ensure efficient processing.

8.2 – Exclusions from the right of withdrawal
Pursuant to applicable regulations, the right of withdrawal may not be exercised in respect of:

  • customized books,

  • audio recordings,

  • computer software,

  • books and charts supplied on digital media.

All nautical charts (whether paper charts supplied rolled, or digital charts) are produced to order and incorporate the latest updates. Pursuant to Article L221-28 of the French Consumer Code, the right of withdrawal shall not apply to the supply of goods that are liable to become rapidly outdated. Accordingly, such charts are neither returnable nor exchangeable. Orders for such Products shall therefore be deemed firm and final upon placement by the Customer in accordance with these General Terms and Conditions of Sale.

Parcels delivered to collection points (including Relais Colis, Mondial Relay, etc.) will not be collected.

8.4 – Specific provisions

  • Digital charts and publications: The right of withdrawal shall not apply to digital products due to their inherent nature.

  • Paper charts: Certain paper nautical charts, referred to as “rolled charts,” are produced to order and incorporate the latest updates. For reasons of obsolescence, such charts are neither returnable nor exchangeable. This limitation is expressly indicated in the relevant chart categories and subcategories.

Article 9 – Product Conformity

We undertake to refund or replace any Product that is defective, damaged or not in conformity with the Order. In such cases, the Customer is required to notify us in writing with a detailed description of the defect and to return the relevant Product(s). Librairie Maritime Nautic Way shall, at the Customer’s option, either exchange or refund the Product(s). Outbound delivery costs shall be reimbursed on the basis of the invoiced rate, and return shipping costs shall be reimbursed upon submission of documentary evidence.

In any event, the Customer shall benefit from the statutory warranties of conformity and hidden defects, in accordance with applicable legislation, including but not limited to those set out in Annex 1 hereto.

The foregoing provisions are without prejudice to the right of withdrawal provided in Article 8.

Article 10 – Refunds

Refunds for Products under Articles 8 and 9 above shall be made as soon as reasonably practicable and in any event no later than thirty (30) days from the date on which the right was exercised. Refunds shall be effected by credit to the payment card originally used for the transaction, or by bank transfer where payment was made by bank transfer (in which case the Customer must provide bank account details).

Cash-on-delivery returns shall not be accepted under any circumstances.

Any promotional benefits obtained at the time of purchase shall be cancelled in the event of a return accompanied by a refund of the relevant Product.
